Filed in New York and obtained by Newsweek, the superseding indictment does not bring any additional charges against the “Bad Boy For Life” rapper, but rather new accusations to support Charges 1 and 3: the racketeering conspiracy charge and transportation to engage in prostitution charge, respectively.

No new co-defendants are named in this indictment. The new filing accuses Combs, 55, of trafficking at least three women over two decades.

“The latest Indictment contains no new offenses. The prosecution’s theory remains flawed. The government has added the ridiculous theory that two of Mr. Combs’ former girlfriends were not girlfriends at all but were prostitutes. Mr. Combs is as committed as ever to fighting these charges and winning at trial.”

Marc Agnifilo, an attorney for Combs, told Newsweek in an email on Thursday, “The latest Indictment contains no new offenses. The prosecution’s theory remains flawed. The government has added the ridiculous theory that two of Mr. Combs’ former girlfriends were not girlfriends at all but were prostitutes. Mr. Combs is as committed as ever to fighting these charges and winning at trial.”

Why It Matters

Combs was arrested in Manhattan in September following a grand jury indictment. He has denied all wrongdoing.

He is also the subject of at least 30 civil lawsuits accusing him of sex crimes.

What To Know

The new indictment includes the following new allegations:

  • Additional speaking allegations regarding racketeering activity
  • Extension of the racketeering conspiracy from in or about 2004 through in or about 2024
  • Additional allegations related to the means and methods of the racketeering enterprise related to sex trafficking, including the trafficking of three specified female victims (“Victim-1,” Victim-2,” and “Victim-3”), and certain acts of violence
  • Additional racketeering activity involving kidnapping, chargeable under New York Penal Law
  • Additional narcotics and controlled substances (specifically psilocin and methamphetamine) included in the racketeering activity involving the possession with intent to distribute and distribution of narcotics and controlled substances in violation of federal law
  • Modification of the “to wit” clause in Count Three to include Victim-1, Victim-2, and Victim-3

What People Are Saying

Kat Pasion, Combs’ former girlfriend, in The Fall of Diddy: “[Combs] came into the room to watch a little bit. He’s walking out of the room, and he says, ‘There’s a little bit of R. Kelly in all of us,’ and then walks out the door.”

Phil Pines, Combs’ former assistant, in The Fall of Diddy on supplying items for the mogul’s parties: “The smell of baby oil is something I don’t ever want to have to smell again.”

“There would be baby oil surrounding the bathtub, and there would be a bathtub full of water, and you would reach down there to unplug, and you would feel the baby oil was in the tub.”

Texas Senator Ted Cruz on The Bulwark, urging President Donald Trump to release the alleged “Diddy List”: “We deserve to know who is implicated in abusing children.”

What’s Next

Combs’ sex trafficking trial is set to begin on May 5 in New York.
